Qualifications

A B-1/B-2 visa can only be issued if a consular officer determines that you meet the requirements for a visa to the United States as forth in the Immigration and Nationality Act of 1965 at the time of application (INA). According to Section 214 of the Immigration and Naturalization Act, every B-1/B-2 petitioner is presumed to be an immigrant (b). Evidence must be presented to dispute this presumption:

  • A short-term trip to the United States, such as to attend a conference or visit a family member in need of medical attention
  • There are specified, limited periods in which you intend to remain in the United States.
  • While in the United States, you will be required to present proof of sufficient funds to meet your living expenses.
  • An international residence, as well as other social or economic links that guarantee your return to your home country at the end of this visit

B-1 visas may be available for specific workers, such as domestic help and crew members on ships operating on the Outer Continental Shelf.
